Terms & Conditions

We reserve the right to modify or cancel any trip due to, but not limited to, unsafe weather conditions, technical difficulties or any other unpredictable cause. This may involve a change in the destination and/or the dives site selection. In the event we cancel a trip customers will have the right to either reschedule their trip at no extra cost or to receive a full refund. Cancellation of reservation must be made in writing to avoid any misunderstanding.

  • 30 days or more prior to departure: 100% full refund
  • 21-29 days before departure: Loss 30% of tour cost
  • 11-20 days before departure: Loss 50% of tour cost
  • 4-10 days before departure: Loss 70% of tour cost
  • 3 days before departure or no show: Loss 100% of tour cost

Certified divers who are minors (12 years old and below) are required to pay the full diving fee regardless of age, and their legal guardian must assume full responsibility for them at all times during the trip.

We will issue booking confirmation to confirm the booked activities, fees, and relevant details with the customer. The customer must confirm within two (2) days and pay 30% of the total fee as a deposit. Otherwise, the booking will be deemed void and cancel.

Sipadan dives and resort/water‑villa bookings require full payment regardless of validity period and are strictly non‑refundable, non‑changeable, and non‑transferable.

All payments are denominated in Malaysian Ringgit (MYR). Any currency exchange rate differences shall be borne by the customer. The prices are also subject to change prior to you making a booking.

Guests must sign a liability release (waiver) and assumption of risk upon arrival and abide by all dive/snorkelling/boat transfer safety rules. You acknowledge and agree that your participation in any of our Tours (except the Sunset Cruise) is subject to you agreeing to a risk acceptance and waiver of liability before participating in the activity.

You further acknowledge that your Tour may expose you to inherent personal risks which may be greater than those present in your everyday life. This could be because of the adventurous nature of activities, travelling by sea and interactions with wildlife. You travel on the basis that you accept these inherent risks and that to the fullest extent permitted by law we will not be responsible for any personal injury or death resulting from the materialisation of an inherent risk.

You acknowledge that the itinerary and/or the Tour’s inclusions may need to change during your Tour due to local circumstances beyond our reasonable control, including but not limited to poor weather and sea conditions. In these circumstances we will endeavour to make suitable alternative arrangements.

We, together with our Dive Guides and Instructors, reserve the right to refuse or terminate service to any individual at any time without refund if a diver or snorkeller is deemed unsafe or irresponsible, fails to follow dive plans, violates regulations, or behaves disrespectfully towards the crew.

Any additional costs incurred due to the customer’s personal reasons for being unable to complete the course within the scheduled timeframe (including boat fees, jetty fees, instructor fees, etc.) shall be borne by the customer and are non‑refundable.

We strongly recommend that if you intend to go on any tour or activity during your trip, you contract an insurance that will cover your intended activities. A good insurance should offer enough protection for full duration of the trip which covers your planned activities, personal injury, death, medical expenses, repatriation expenses, helicopter rescue, air ambulance and adequate cover for baggage and valuables.

We strongly recommend that all customers also purchase Evacuation and Medical cover for scuba diving. Scuba diving and In‐water activities are not covered by all Travel Insurance Policies, and policy wordings should be read carefully.

We strongly recommend waiting at least 18 hours or more after diving before flying or travelling by bus to Kota Kinabalu (which involves ascending to altitudes above 300 metres), in order to reduce the risk of decompression sickness. Please pay attention to the return time of your plane.

Guests are responsible and liable for all damages rendered to any Roach Reefs Tours’ property and will be charged accordingly for replacement. We will not be responsible or liable for guests’ own property and belongings.

We cannot be held responsible, or in any way liable, for such things as property losses or damages, personal losses, accidents, medical expenses, repatriation expenses, helicopter rescue, air ambulance, oxygen chamber, additional boat rental, injuries or death for any reason, whether through activities organised by us or booked through us, or caused to you by third parties connected or not connected to us. We’re not liable for any additional expenses incurred by a guest whatever may be the reason or circumstances of these expenses.

All diving guests are required to sign a self-declaration medical. If you are taking part in a diving course on-board, you are required to a sign a medical form prior to starting the course. If you have, or think you have, any of the medical conditions listed you will need signed clearance from a doctor valid within 6 months of your planned trip. Where doctor’s clearance is needed, we ask you to arrange this before arrival where possible and to bring it with you to avoid any delays and additional costs. No last minute itinerary changed or activities changed is acceptable or refundable due to the medical conditions of scuba diving with the Divers Medical Questionaire.
